Town Meeting Warrant Article of the Day: Articles 35, 36, and 37

As we ready for Town Meeting on May 16, 2023, the Town will be presenting information every day on different warrant articles.


2023 Town Meeting Warrant

Articles 35, 36, and 37 are housekeeping articles due to Article 34.   

Article 35:  Amend Zoning Bylaw – Section 2, Definitions.

This Article proposes to delete the definition of Day Care Center.  The reason for the deletion is that Article 34 proposes to include a definition for ‘child care facility’ that is consistent with MGL c. 40A §3 (also known as the Dover Amendment) within Article 8 Supplementary Regulations, Part 3 Site Plan Review. 

Article 36:  Amend Zoning Bylaw – Day Care Center.

This Article eliminates the use special permit requirements for a day-care center, as a day-care center is a use consistent with MGL c. 40A §3 (also known as the Dover Amendment) and renames day-care center as a child care facility, again, consistent with MGL c. 40A §3.

Article 37:  Amend Zoning Bylaw – Chapter 195, Attachment 2, Table 1 – Summary of Use Regulations.

This Article proposes to rename day-care center as child care facility and explains which zoning districts permit child care facilities. In addition, the Article eliminates the special permit requirement for the use.

Article 34:  Amend Zoning Bylaw – Article 8 Supplementary Regulations

This Article proposes to create a formal review process with the Planning Board as the regulatory authority for proposed uses that are consistent with MGL c. 40A §3 (also known as the Dover Amendment).

The Dover Amendment exempts agricultural, religious, and educational uses from certain zoning restrictions. By limiting what zoning requirements apply to land and structures that hold these uses, the Dover Amendment makes it easier for these uses to build structures to serve their needs.

Article 33:  Amend Zoning Bylaw – Article 13:  Continuing Care Retirement Center

This article proposes to amend the Continuing Care Retirement Center (CCRC) bylaw by allowing an applicant to permit a second CCRC on a separate lot without the requirement for a nursing care facility or congregate housing units on the lot of the second CCRC, provided the second CCRC and all housing types on the lot are affiliated with its existing nursing home care facility in the Town of North Andover.

Reminder: Town Meeting Child Care Service for North Andover School Age Students (K-6th) – Registration Required

Community Programs, at the request of the Town Moderator Mark DiSalvo, will be offering a child care service to families attending Town Meeting at the High School on Tuesday May 16, 2023. It is provided to North Andover school age students (K – 6th grade). Please be advised that this is not a drop in program and you must pre-register for a spot in order for us to properly staff the program.  Drop off will begin at 6:25PM and we ask that you pick up your child no later than 10:00PM.

Location:  North Andover High School
Time:  6:30PM – 10:00PM
Cost:  Free

The North Parish Peoples Pantry will be accepting non-perishable food items at Annual Town Meeting on Tuesday, May 16, 2023.

The Annual Town Meeting will be held on Tuesday, May 16, 2023 at 6:30 PM. It will take place in the North Andover High School Auditorium.  The Town Moderator invited the North Parish Peoples Pantry  and they will be accepting donations of non-perishable food items to aid those of our neighbors who are food insecure.  While they will accept any non-perishable foods, they are in particular need of canned tuna, peanut butter, and macaroni and cheese.
